I am reviewing the incoming flights at [port of entry removed] and I have notice an aircraft coming in on Monday, June 24th, 2013. The aircraft has tail number F-HBFC and lists two passengers that are citizens of France. I could not locate any U.S. VISA’s for either of these passengers, they must have U.S. VISA’s to enter at [port of entry removed].
[Port of Entry Removed] is a general aviation site and they cannot use the visa waiver program to enter. They cannot use ESTA to enter.
Please contact this office before this aircraft arrives. If they do not have U.S. VISA’s they will be denied entry and the pilot may be subject to penalty.
Thank you,

Good morning sir,
I will be the pilot in command for the Aircraft F-HBFC. The two french passengers shall obtain the visa waiver at a land border crossing in advance. They will be crossing the land border between New-Brunswick and Maine and paying the required fee. We are aware that the initial entry cannot be made using the visa waiver program unless on a signatory carrier.
The proposed entry on the 24th of June should be a re-entry using the provisions of 8 CFR PART 217 § 217.3
§ 217.3 Maintenance of status.
...
(b) Readmission after departure to contiguous territory or adjacent island. An alien admitted to the United States under this part may be readmitted to the United States after a departure to foreign contiguous territory or adjacent island for the balance of his or her original Visa Waiver Pilot Program admission period if he or she is otherwise admissible and meets all the conditions of this part with the exception of arrival on a signatory carrier.
Are you telling me that [port of entry removed] is unable to process Aliens under the provision of 8 CFR 217.3? If it is the case, I will select a different port of Entry and let you know of our intentions. We will most likely use Albany Airport if [port of entry removed] is unable to process this re-entry.
I will call you over the phone anyway during the day to clarify the situation.
Kind Regards,

Marc-Olivier,
As long as you are aware of the regulations and they enter at a land border prior to coming to Burlington then we can re-validate their entry.
The problem we encounter quite often is that people assume they can enter in the air environment using a combination of the VWP and ESTA and then they get here and have a big problem.
Thanks,
Cordialement,
Marc-Olivier
